PLACEMENT OF A BID CONSTITUTES A LEGALLY BINDING CONTRACT. By registering, bidding, purchasing, or participating in any Southern Collectibles LLC auction or private sale, the bidder acknowledges that they have read, understood, and agreed to all Terms and Conditions contained in this document.
1. SOLD AS-IS / WHERE-IS / WITH ALL FAULTS
All items are sold strictly AS-IS, WHERE-IS, WITH ALL FAULTS. Southern Collectibles LLC makes no representations or warranties of any kind regarding authenticity, condition, grade, weight, metal content, provenance, merchantability, or investment value. The bidder assumes all risk regarding the purchase and agrees that no reliance is placed on any description or opinion provided.
2. BIDDER DUE DILIGENCE
Bidders are solely responsible for verifying, inspecting, testing, and authenticating items prior to bidding. Bidders may schedule an appointment to inspect items and may bring testing equipment or specialists including numismatists, metallurgists, jewelers, or other professionals.
3. ALL SALES FINAL
All sales are final. No refunds, cancellations, returns, or exchanges will be accepted unless authorized in writing by Southern Collectibles LLC.
4. PAYMENT TERMS
All billing is conducted via Southern Collectibles LLC in-house invoicing. Payment is due upon receipt of invoice unless otherwise stated. Invoices exceeding $3,000 require payment via wire transfer unless otherwise approved in writing.
5. WIRE TRANSFER FINALITY
Bidders acknowledge that wire transfers are irrevocable payment instruments. By sending a wire transfer, the bidder confirms that the payment is intentional, authorized, and final. Any attempt to recall or dispute a wire transfer after delivery of merchandise constitutes breach of contract.
6. PROHIBITION OF PAYMENT REVERSALS
Bidders expressly agree not to initiate chargebacks, wire recalls, ACH reversals, stop-payments, credit card disputes, or other payment reversals after goods have been delivered or shipped.
7. CHARGEBACK FRAUD POLICY
Initiating a chargeback, dispute, or payment reversal after shipment or delivery of merchandise constitutes breach of contract and may be treated as civil fraud. Southern Collectibles LLC reserves the right to pursue full recovery of funds including merchandise value, resale losses, administrative costs, legal fees, collection fees, and all associated damages.
8. CHARGEBACK PENALTY CLAUSE
If a bidder initiates a chargeback, payment dispute, or reversal after shipment or delivery of merchandise, the bidder agrees to pay liquidated damages equal to 35% of the total invoice amount in addition to the original invoice balance, resale losses, administrative costs, and legal expenses. This amount represents a reasonable estimate of damages associated with fraud investigations, inventory recovery, resale losses, and administrative costs.
9. NON-PAYING BIDDER RESALE POLICY
If a bidder fails to remit payment within the stated payment period, Southern Collectibles LLC reserves the right to cancel the transaction and resell the merchandise without further notice. The original bidder remains liable for any difference between the original hammer price and the resale price, along with all administrative fees, storage costs, marketing costs, and collection expenses.
10. TITLE RETENTION
Title to purchased merchandise remains with Southern Collectibles LLC until full payment has been received and cleared. Ownership does not transfer until payment is final.
11. SHIPPING AND DELIVERY CONFIRMATION
Shipment tracking numbers, carrier delivery scans, signature confirmation, insurance documentation, and shipping carrier records shall constitute proof of delivery. These records shall be considered valid evidence in any dispute regarding delivery or receipt of merchandise.
12. SHIPPING RISK TRANSFER
Risk of loss transfers to the buyer upon delivery to the shipping carrier unless otherwise stated in writing. Insurance purchased for shipment covers loss during transit only and does not constitute a return privilege.
13. IDENTITY VERIFICATION
Southern Collectibles LLC reserves the right to request identity verification prior to approving bids, shipping merchandise, or completing transactions. Verification may include government-issued identification, proof of address, bank verification, phone verification, or other documentation deemed necessary to prevent fraud.
14. FRAUD INVESTIGATION AUTHORIZATION
By participating in the auction, bidders authorize Southern Collectibles LLC to investigate suspected fraud, payment disputes, or account misuse and to share relevant information with financial institutions, payment processors, auction platforms, shipping carriers, fraud prevention databases, and law enforcement authorities as necessary.
15. FRAUD AND BANK REPORTING
Southern Collectibles LLC reserves the right to report suspected fraud, payment reversal attempts, deceptive conduct, or non-payment activity to financial institutions, payment processors, fraud investigation units, credit bureaus, auction platforms, and law enforcement agencies.
16. PERSONAL GUARANTEE
Any individual placing a bid on behalf of a company, business entity, trust, or organization personally guarantees payment of the invoice and performance of all obligations under these Terms and Conditions.
17. LIQUIDATED DAMAGES
If a bidder fails to complete payment or attempts payment reversal, Southern Collectibles LLC may recover liquidated damages including invoice value, resale loss, administrative costs, legal fees, collection expenses, and any difference in resale price.
18. STORAGE FEES
Any merchandise not paid for or not shipped within the required timeframe may be subject to storage fees of $10 per item per day or 1% of the invoice value per week, whichever is greater.
19. CONSIGNOR INDEMNIFICATION
Southern Collectibles LLC acts as an agent for consignors. Bidders agree to indemnify and hold Southern Collectibles LLC and consignors harmless from damages resulting from bidder default, fraudulent disputes, or payment reversals.
20. UCC SECURITY INTEREST
Southern Collectibles LLC retains a security interest in all merchandise until invoices are paid in full. Southern Collectibles LLC shall have all rights of a secured creditor under the Uniform Commercial Code (UCC).
21. COLLECTION COSTS
Any unpaid invoices referred to collections or legal counsel will incur all attorney fees, court costs, administrative fees, interest, collection costs, and recovery expenses permitted by law.
22. BIDDER ACCOUNT SUSPENSION
Southern Collectibles LLC reserves the right to suspend, restrict, or permanently ban bidding privileges for any individual or entity at its sole discretion.
23. PLATFORM COOPERATION
Southern Collectibles LLC reserves the right to share bidder conduct, fraud reports, and payment dispute information with auction platforms and industry partners for the purpose of fraud prevention.
24. LIMITATION OF LIABILITY
Southern Collectibles LLC shall not be liable for market fluctuations, grading disputes, authentication disagreements, investment losses, or any indirect or consequential damages arising from participation in the auction.
25. ARBITRATION AGREEMENT
All disputes shall be resolved through binding arbitration conducted in Madison County, Alabama. Bidders waive the right to jury trial and agree that arbitration shall be the sole remedy for dispute resolution.
26. GOVERNING LAW
These Terms and Conditions shall be governed by and interpreted under the laws of the State of Alabama.
27. ACCEPTANCE OF TERMS
By placing a bid, the bidder acknowledges acceptance of these Terms and Conditions and confirms that they are entering into a legally binding agreement with Southern Collectibles LLC.
BIDDER REGISTRATION POLICY

Bidder Registration Agreement
This Bidder Registration Agreement must be completed before participation in any Southern
Collectibles LLC auction. By signing this document, the bidder acknowledges and agrees to all Terms
and Conditions of Southern Collectibles LLC.
1. Legal Agreement
Placement of a bid constitutes a legally binding contract between the bidder and Southern Collectibles
LLC.
2. Identity Verification
Bidders must provide a valid government-issued photo ID and accurate contact information before
being approved to bid.
3. Payment Obligation
Winning bidders agree to pay all invoices in full according to the payment terms specified by Southern
Collectibles LLC.
4. Inspection Responsibility
Bidders acknowledge that they have had the opportunity to inspect items or arrange inspection before
bidding.
5. Fraud Prevention
Bidders agree not to initiate chargebacks, wire recalls, payment reversals, or fraudulent disputes after
receiving merchandise.
6. Personal Guarantee
If bidding on behalf of a company, the individual registering personally guarantees payment of all
winning bids.
7. Legal Jurisdiction
All disputes shall be governed by the laws of the State of Alabama and handled in Madison County,
Alabama.
WIRE TRANSFER POLICY

Wire Transfer Acknowledgment Form
This form confirms that the bidder understands the nature of wire transfer payments and agrees to the
payment policies of Southern Collectibles LLC.
1. Wire Transfer Finality
Wire transfers are immediate and irreversible once processed. By sending a wire transfer, the bidder
acknowledges that the payment is final.
2. No Wire Recall
The bidder agrees not to request a recall of a wire transfer after merchandise has been delivered or
shipped.
3. Fraud Reporting
Any attempt to fraudulently reverse payment may be reported to financial institutions and law
enforcement agencies.
4. Payment Confirmation
The bidder confirms that all wire transfers sent are authorized and voluntary.5. Legal Responsibility
The bidder accepts full legal responsibility for payment and agrees to Southern Collectibles LLC Terms
and Conditions.
